Introduction to the Post Office Scandal
The first-ever capture case at the Court of Appeal has been delayed as the Post Office seeks an extension. This case involves Pat Owen, a former subpostmaster who was convicted of theft in 1998 based on evidence from computer software.
The Capture System
The system known as Capture was used in up to 2,500 stores in the 1990s, before the infamous Horizon system was introduced. Hundreds of subpostmasters were wrongfully convicted in the criminal case between 1999 and 2015, known as the Horizon scandal. Earlier this year, a report from 1998 was discovered that showed the Capture software was also flawed.
The Case of Pat Owen
Pat Owen was given a suspended sentence and subsequently fought to clear her name, but she died in 2003. Her case was referred to the Court of Appeal by the Criminal Cases Review Commission (CCRC) in October. The Post Office had until December 5 to respond to documents submitted by Ms Owen’s defense team, but they have now requested an extension until January 30.
Impact on the Family
Ms Owen’s daughter described the family’s distress at the extended wait. She emphasized the profound impact that the ongoing delay is having on their family, stating that constant uncertainty only increases their grief, stress, and anxiety. The family has waited 27 years for justice, and this additional wait feels endless.
Potential Exoneration
Lawyers said a posthumous exoneration of Ms Owen could expedite treatment for others. The CCRC chair also stated that it could be a touchstone case for other victims. The CCRC continues to investigate approximately 30 other convictions that predate Horizon.
Post Office Response
A Post Office spokesman said they have requested an extension of time to fully consider and respond to the CCRC’s reasoning in Ms Owen’s case. They deeply regret the impact their request for more time will have on Ms Owen’s family and have a duty to carefully consider the evidence set out in the CCRC’s reasons.
Compensation Scheme
The first compensation scheme for victims of the Post Office Capture IT scandal was launched this autumn. The Capture Redress Scheme provides for payments of up to £300,000, and more in exceptional cases, to former postmasters who have suffered financial losses.
