Introduction to the Case

A judge has dismissed a defamation lawsuit filed by Drake against Universal Music Group over a song by Kendrick Lamar called "Not Like Us". The song contained texts that accused Drake and his associates of being "certified pedophiles". Judge Jeannette Vargas ruled that these texts were "unimpeachable opinions" and could not be considered defamatory.

Background of the Lawsuit

Drake filed the lawsuit in January, accusing Universal Music Group (UMG) of defamation by allowing the song’s release and promotion. He claimed that the song spread a "false and malicious narrative" about him. However, Judge Vargas disagreed, stating that the broader context of a heated rap battle involving inflammatory language and offensive accusations from both participants would not lead a reasonable listener to believe that "Not Like Us" conveys verifiable facts about Drake.

The Song’s Impact

"Not Like Us" was originally released in May 2024 and was widely seen as the decisive blow in an ongoing battle between the rival rappers. The song has become the biggest hit of Lamar’s career, winning five Grammys and was one of the most talked-about moments from his Super Bowl halftime show in February. The judge called the dispute between the rappers "the most infamous rap battle in the history of the genre".

The Judge’s Ruling

In a 38-page order, Judge Vargas explained that the artists’ seven-song rap battle was a "war of words" that was the subject of intense media scrutiny and online discussion. She stated that while the allegation that Drake is a pedophile is certainly serious, it is not a verifiable fact that can be considered defamatory in the context of a rap battle. Drake’s spokesman said he plans to appeal the ruling.

Reaction to the Ruling

Universal Music Group was satisfied with the result and looked forward to continuing their collaboration with Drake. A UMG spokesman told CBS News that the lawsuit "was an affront to all artists and their creative expression and should never have seen the light of day". The spokesperson added that they are pleased with the court’s dismissal and look forward to successfully continuing their work to promote Drake’s music and invest in his career.
