Diarra had attempted to terminate his contract with Lokomotiv Moscow in 2014 but was unable to join a Belgian club due to FIFA’s transfer laws at the time. The ECJ ruled that these laws hindered the free movement of professional footballers seeking to work for a new club. Although FIFA has since revised these laws, the changes are considered insufficient by supporters.

Unlike regular EU workers, footballers are bound by contracts that restrict their ability to seek employment elsewhere without their current employer receiving a transfer fee or until their contract expires. This unique employment status is a result of FIFA’s transfer laws, which have been in place for decades. The concept of buying out a contract is relatively new in football, introduced only in 1995 following the Bosman ruling, named after the player who brought the case.

FIFA has been reported to be considering legal steps to address the threat, while the German Football Association (DFB) has confirmed receipt of correspondence from JFP, which is currently being reviewed internally. The potential implications of this lawsuit are far-reaching, and the outcome could significantly alter the economic and regulatory landscape of professional football in Europe.
