The nurses from Darlington Memorial Hospital responded to the situation by launching employment tribunal proceedings against NHS bosses.<\/p>\n<h2>Background<\/h2>\n<p>The trust&#8217;s workplace transition policy allowed an individual to use the same-sex space that corresponded to their gender identity, and anyone of that gender who objected could transition elsewhere. About 26 nurses signed a letter complaining about the transgender woman&#8217;s use and behavior in the locker room.<\/p>\n<h2>Tribunal Ruling<\/h2>\n<p>In its ruling, the three-judge panel said the trust had harassed and discriminated against the nurses by requiring them to share a changing room with a &quot;biological trans male&quot; and then failing to take their concerns seriously. However, the panel found the nurse&#8217;s allegations about the transgender woman&#8217;s behavior in the changing room to be &quot;unsubstantiated&quot; and dismissed them along with claims the women had been victimized.<\/p>\n<h2>Findings<\/h2>\n<p>The ruling said the trust&#8217;s policy had an &quot;admirable and noble purpose&quot; but had the effect of &quot;violating the dignity&quot; of nurses and &quot;creating a hostile, humiliating and degrading environment for them&quot;. The panel also concluded that the nurses were \u201ccorrect in their assumption\u201d that management would not address \u201cthe core issue,\u201d which was the use of the female locker room by a \u201cbiological transmale male.\u201d<\/p>\n<h2>Reaction to the Ruling<\/h2>\n<p>The nurses were pleased with the verdict, with one of them saying it was a &quot;victory for common sense&quot; and a &quot;watershed moment.&quot; They stated that women deserved access to single-sex spaces \u201cwithout fear or intimidation\u201d and that the trust\u2019s policies had been \u201cdegrading\u201d and \u201cdangerous\u201d. The trust said it was &quot;taking the time to review the ruling&quot; and would make further comment &quot;once we have had the opportunity to fully review it&quot;. <\/p>\n<h2>Outcome<\/h2>\n<p>The court said the nurses were \u201centitled to a remedy\u201d and encouraged all parties to agree on a remedy without the need for further hearings. The trust&#8217;s policy was withdrawn as a result of a Supreme Court ruling that decided the legal definition of a woman should be based on biological sex.
